For the Tender Participant:
- Withdrawal of a tender proposal/offer: If you withdraw your offer after the submission deadline, but before its validity period expires.
- Non-signing of the contract: If you become the winner of a tender/simplified procurement but fail to sign the procurement contract.
- Failure to provide contract performance security: If you become the winner of a tender/simplified procurement and do not provide contract performance security after receiving notification of intent to conclude a contract (if such provision is required by the tender documentation/announcement).
- Failure to provide documents to confirm absence of grounds for refusal: If you become the winner of a procurement procedure (excluding negotiated procedures) and fail to provide, within the period specified by the Law of Ukraine "On Public Procurement" or other regulatory acts of Ukraine, documents confirming the absence of grounds for refusal to participate in the procurement procedure.
For the Tender Winner:
- Non-performance or improper performance of obligations: The Policyholder, as the tender winner, fails to perform or improperly performs their obligations under the Contract (agreement).
